Surrogacy in Kyrgyzstan

For many individuals and couples facing the heart-wrenching challenges of infertility, surrogacy offers a profound and viable pathway to realizing their dreams of parenthood. Kyrgyzstan has emerged as a particularly attractive destination for surrogacy, thanks to its supportive legal environment, the high standards of its medical facilities, and the presence of experienced, dedicated professionals.

Why Kyrgyzstan?

Strong Legal Framework: Kyrgyzstan provides a clear legal framework for surrogacy, protecting the rights of all involved. This transparency and security are key advantages, with mandatory notarized agreements outlining responsibilities and rights, minimizing legal risks for intended parents.

High-Quality Medical Care: Modern, European-standard IVF centers with cutting-edge technology and experienced specialists ensure top-tier medical care in Kyrgyzstan. This commitment to excellence maximizes the chances for a healthy and successful pregnancy for both intended parents and surrogates.

Is surrogacy right for me?

Surrogacy often emerges as a viable solution when women are unable to carry a pregnancy to term themselves for medical reasons:

Absence or abnormality of the uterus making it either impossible or unsafe for a woman to be pregnant herself

Recurrent pregnancy losses

Recurrent failed IVF cycles

How does it work?

1.Initial Enquiry and Information Gathering

2.Surrogate Mother Matching and Selection

3.Legal Agreements and Contractual Framework

4.Medical Preparation and Embryo Transfer

5.Pregnancy, Delivery, and Post-Birth Legalities

Stages of the surrogacy program

01

Preparation and medical consultation

Discussions on the program's legal, medical, and financial aspects and detailed planning of the whole process.

02

Appointing surrogate mother

All potential surrogate mothers undergo a strict selection process, including medical examination, psychological assessment, and background checks through available means.

03

Legal arrangements

Before medical procedures begin, all parties sign legal documents that define their rights and responsibilities. These measures ensure the protection of all parties involved.

04

Medical preparation

The surrogate mother undergoes medical preparation for the embryo transfer procedure that includes hormone replacement therapy, individually selected for her by a fertility specialist. The intended parents undergo the procedures required for obtaining embryos in advance.

05

Embryo transfer

Fertility specialist transfers the obtained embryos into the uterine cavity of the surrogate mother. Then, following a 10 to 12-day period of waiting for the result, a blood test for hCG shows whether pregnancy has occurred.

06

Pregnancy and delivery

Throughout the whole period of pregnancy, the surrogate mother receives medical care of the highest standard at the agency’s clinic in Bishkek. Genetic parents get regular updates on the pregnancy status from the surrogate mother's personal case manager. Legal registration is arranged as soon as possible after the birth so that parents can take the child home.

Our job is to give happiness

In Kyrgyzstan, surrogacy is legal

kyrgyzstan surrogacy laws

Yes, we will arrange the transportation of embryos to Bishkek, and also process all the documents remotely.

Couples: Provide a notarized and apostilled marriage certificate, a Power of Attorney (POA) signed at a notary in Kyrgyzstan (or an apostilled POA obtained outside of Kyrgyzstan), and a notarized translated copy of passports.

Unmarried Clients: Provide an apostilled certificate of no marriage for both parties, a Power of Attorney (POA) signed at a notary in Kyrgyzstan (or an apostilled POA obtained outside of Kyrgyzstan), and a notarized translated copy of passports.

Single Women: Provide an apostilled certificate of no marriage, a Power of Attorney (POA) signed at a notary in Kyrgyzstan (or an apostilled POA obtained outside of Kyrgyzstan), and a notarized translated copy of passport.

Single Men: Because the new law does not yet have specific regulations, it is recommended to start the project as an unmarried couple.

According to Article 104, Section 7 of the newly enacted Law on the Protection of Citizens’ Health, effective January 12, 2024, “The individuals who entered into a contract for the implantation of an embryo into another woman for reproductive purposes are, at the time of the child’s birth, registered as the parents at the civil registry office.”

The new law does not specify any age requirements or restrictions for men or women. However, the hospital will assess each patient’s case based on their medical test results. For example, if a man is 65 years old but his sperm quality is suitable, there is no issue.

Typically, two visits are required. The first visit is for obtaining the apostille for the POA, and if ovarian stimulation is needed, it will take 15-20 days, or about 3 days if donor eggs are used. The second visit is about one week before the baby’s expected birth, to process paperwork for the baby’s return to their home country, which will require a stay of approximately 20 days.

If clients obtain the apostille for the POA and other required documents outside of Kyrgyzstan and send the original apostilled documents to Bishkek, and also have sperm or embryos transported to the clinic in Bishkek, then clients will only need to arrive about one week before the baby is due to be born to process paperwork, staying for around 20 days.

If a client has obtained the POA and the original document has been received by the hospital, the client’s representative can sign the medical contract on behalf of the client at the hospital.

Yes, co-stimulation between China and Kyrgyzstan is accepted, but an ultrasound at a clinic in Kyrgyzstan is required three days prior to egg retrieval, meaning at least two days before the trigger shot, in order to carry out the scan. They have experience in co-stimulation programs with Russia, requiring online communication throughout the process, including the monitoring results for the woman.

There are no special requirements for a foreign surrogate mother or a surrogate brought by the client. The same applies to former Soviet countries, Thailand, and Malaysia. Initial medical examinations and subsequent follow-ups must be done in Kyrgyzstan, with the entire process, including the birth, completed in Kyrgyzstan.

Reports from tertiary level hospitals in China are accepted if translated and notarized.

A maximum of two embryos can be transferred at one time.

The surrogate mother will sign a four-party contract with the client’s authorized representative.

If a foreign surrogate mother is used for the program in Kyrgyzstan, the initial check-up can be done abroad, but all subsequent check-ups must be done in Kyrgyzstan.

PGS results take 7-14 days, and DNA test results take 7 days. The partnered hospital sends the samples directly for testing.

No, the birth certificate application requires documentation confirming that the embryo transfer was done in Kyrgyzstan. This includes the surrogacy contract signed prior to the transfer and the medical contract with the hospital. If the embryo transfer was not done in Kyrgyzstan, the necessary documentation will be missing, and the birth certificate application will be delayed.
